1. Vogogo Inc. and its affiliates, successors, assigns and agents, (herein collectively “Vogogo”) recognize the importance of protecting any personal information we receive from you. Vogogo is committed to maintaining the accuracy, confidentiality and security of your personal information. Vogogo is dedicated to providing you with superior service while protecting your privacy and safeguarding your personal information.

2. “Personal information” is any information that may identify you as an individual, and includes any factual or subjective information about you, such as your age, name, address, telephone number, email address, screen name, occupation, and credit, banking, payment or other financial information.

3. This Website Privacy Policy (“Policy”) describes how Vogogo collects, uses, stores and protects personal information collected through the Vogogo website. This Policy applies solely to information collected through the Vogogo website at https://www.vogogo.com (the “Site”), and does not apply to information collected through any other sources, including, without limitation, Facebook, Twitter, YouTube and other third party and social media websites. By using the Site, you agree to all the terms and conditions in this Policy regarding the use of the Site and regarding the collection, use and disclosure of your personal information. If you do not agree with any term of this Policy, please do not use the Site and please do not provide Vogogo with any personal information.

4. All personal information Vogogo collects through the Site is protected in accordance with this Policy. Vogogo may from time to time change its Policy in order to ensure the protection of your personal information as new Vogogo products and services are added or old ones changed. Changes will be effective when a revised Policy is posted at the Site. Please check this Policy regularly for updates.

1. Collecting personal information is essential to Vogogo being able to enhance your experience using Vogogo products and services by ensuring an efficient, secure and customized process. Personal information may come directly from you, or it may also be provided by Vogogo’s affiliates, subsidiaries, parent companies, successors, promotional partners or other third parties.

2. Personal Information may be used:

i) to determine eligibility for Vogogo products and services;

ii) to process transactions and provide you with notices of those transactions, and to provide and maintain products and services to you;

iii) to understand and assess your ongoing needs and offer Vogogo products and services to meet those needs;

iv) for fee billing, accounting and collection purposes relating to Vogogo products and services;

v) to update you with respect to Vogogo products and services, if you have consented to such communication;

vi) to assist customer service representatives in communication, service and administration;

vii) to respond to your questions, comments, and requests; to provide you with access to certain areas and features on the Site;

viii) to communicate with you about your activities on the Site;

ix) to investigate suspected fraud, harassment, physical threats, or other violations of any law, rule or regulation, the rules or policies of the Site, or the rights of third parties; or to investigate any suspected conduct which Vogogo deems improper;

x) to the extent that you provide Vogogo with financial information (such as credit card or bank account numbers) in connection with the services offered on the Site, Vogogo may use the financial information that you provide to fulfill your order;

xi) to help Vogogo develop, deliver and improve Vogogo’s products, services, content and advertising;

xii) for internal purposes, such as data analysis and research;

xiii) for internal, external and regulatory audit purposes;

xiv) to comply with legal and regulatory requirements;

xv) to share or exchange reports and information with credit reporting agencies, credit bureaus, and any other person, corporation, firm or enterprise to verify the accuracy of personal information; and

xvi) where Vogogo has reasonable grounds to believe the information could be useful when investigating a contravention of a federal, provincial or foreign law or in order to protect or defend a legal interest.

3. Personal information may also be used for purposes other than those listed above, subject to obtaining your prior consent for such use.

When using the products and services of Vogogo you may be required to provide Vogogo the following information:

i) name, address, email and telephone number;

ii) occupation,employer;

iii) identification information, such as utility bills, bank statements, social insurance/social security number and other government issued identification cards;

iv) financial information for online purchases, such as bank account or credit card information;

v) payment or transaction amount and/or status; and

vi) IP address, domain name (not the email address), and browser and platform type (eg., Netscape browser on a Microsoft platform).

In addition, when you connect to the Site, certain technical, non-personally identifiable information which does not identify any individual may be collected and stored by “cookie” technology and IP addresses. Personal information is not collected in this process. “Cookies” are small pieces of information that are stored by your browser on your computer’s hard drive, including but not limited to your IP host address, internet browser type, personal computer settings, and the number, duration, and character of page visits. Vogogo uses cookies to record your session information (such as your selections of goods andservices when ordering), record user-specific information on the pages you select for viewing, tailor the Site content to your interests and retain your answers to Vogogo’s questions regarding residency. If you do not wish to accept cookies, you can modify your browser preferences to reject/disable them or to alert you when cookies are being sent; however, if you choose to reject/disable all cookies, Vogogo may be unable to optimize your visit to the Site and you may be unable to use parts of the Site.

By visiting the Site, you expressly consent to the collection of your personal information by Vogogo and expressly authorize the retention and use of your personal information by Vogogo in the manner set out in this Policy. If you do not wish Vogogo to collect, retain and use your personal information in this manner, please do not provide personal information on the Site.

2. When you request products and services from Vogogo, you will be prompted to provide information that enables Vogogo to respond to your request. By entering the information, you consent to our collection, retention and use of such personal information, and its disclosure to appropriate third parties for the purposes set forth in this Policy and such other purposes as you may otherwise have consented.

3. In the event that you provide personal information to Vogogo, Vogogo may contact you and you authorize Vogogo to contact you from time to time thereafter. If you do not wish to be contacted by Vogogo, either refrain from providing personal information on the Site, or signify that you do not wish to have Vogogo make further contact with you.

4. Your consent remains valid even after the termination of Vogogo’s relationship with you, unless you provide Vogogo with written notice that such consent is withdrawn.

5. In most cases, you can withdraw your consent to the collection, use, retention or disclosure of your personal information at any time, by notifying Vogogo in writing. By withdrawing your consent, Vogogo may not be able to provide you with some or all Vogogo products or services.

6. In certain circumstances, consent cannot be withdrawn, such as where personal information is required for insurance policy issuance or renewal, insurance underwriting or claims administration of current policies. There are also exceptions where Vogogo does not need to obtain consent or explain the purposes for the collection, use or disclosure of personal information. For example, this exception would apply if there is an emergency that threatens the life, security or health of an individual, or if Vogogo must comply with a court order.

1. Vogogo is not in the business of selling client lists or personal information to others. In providing its products and services, Vogogo may need to disclose personal information to its affiliates, subsidiaries, parent companies, successors, or other third parties as required to perform functions on Vogogo’s behalf in connection with the Site (such as administration of the Site, administration of promotions or other features on the Site, marketing, data analysis, and customer services). In order to share such information, it may be necessary for Vogogo to transmit your personal information outside the jurisdiction set forth below, and your personal information may be subject to law enforcement and national security laws applicable in that jurisdiction, and you agree to this transfer. Further or other use or disclosure of your personal information by these parties for other purposes is not permitted.

2. Vogogo will only disclose your personal information to third parties other than its affiliates, subsidiaries, parent companies, successors and promotional partners:

i) where you have given us your consent to disclose such personal information for a designated purpose, including by agreeing to this Policy;

ii) where such third parties are acting on our behalf as agents, suppliers or service providers, solely to perform functions on Vogogo’s behalf in connection with the Site (such functions may include, but are not limited to, order fulfillment, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data and providing marketing assistance, processing credit card payments, and providing customer service).

iii) as may be set out in the Terms and Conditions applicable to any of the products and services of Vogogo, to facilitate the provision of such product or service;

iv) as required by law or regulation, including an order of any court or other body with authority to compel the disclosure of such personal information;

v) in connection with legal proceedings or as necessary for establishing, defending, or exercising legal rights;

vi) in an emergency to protect the health or safety of users of the Site or the general public, or in the interests of national security; and

vii) in connection with Vogogo undergoing a corporate reorganization, or negotiating or undergoing a merger or amalgamation with another entity, or negotiating or undergoing a sale of its assets, provided that the personal information so disclosed continues to be used for the purposes permitted by this Policy by the entity acquiring the personal information. Also, if any bankruptcy or reorganization proceeding is brought by or against Vogogo, such personal information may be considered an asset of Vogogo’s and may be sold or transferred to third parties.

3. Except as provided for herein, Vogogo will not provide any of your personal information to any third parties without your consent.
1. Vogogo takes physical, administrative, procedural and technological precautions to protect our systems and all personal information under our control against unauthorized access and use. Vogogo’s security safeguards protect your personal information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. All safety and security measures are appropriate to the sensitivity level of the information collected.

2. Vogogo uses industry-standard encryption technologies when transferring and receiving customer data exchanges with Vogogo’s Site server. All other data transferred is conducted through a secure phone line.

3. Vogogo’s service providers and agents are required to maintain confidentiality, and may not use the personal information under Vogogo’s control for any unauthorized purpose.

4. Employees of Vogogo are governed by strict standards and policies to ensure that personal information is secure and treated with the utmost care and respect.

5. Although Vogogo has put in place reasonable and appropriate safeguards to protect the security of the personal information it collects as aforesaid, due to the inherent open nature of the Internet, Vogogo cannot guarantee that communications between you and Vogogo or information stored on the Site or Vogogo’s servers will be completely free from unauthorized access by third parties, such as hackers or legally required access by law enforcement authorities. Your use of the Site demonstrates your voluntary assumption and acknowledgement of this risk.

6. To the fullest extent permitted by law, Vogogo disclaims all liability and responsibility for any damages (including, but not limited to, any and all direct, special, indirect, consequential, or punitive loss or other damages of any kind, whether in contract (including fundamental breach), tort (including negligence), or otherwise) that you may suffer due to any loss, unauthorized access, misuse, or alteration of any information you submit to the Site.

7. Your use of the Site is authorization to Vogogo to retain information that Vogogo collects as long as it is deemed necessary and relevant by Vogogo for Vogogo’s operations unless a longer retention period is required or permitted by law.

1. It is important that the personal information you provide Vogogo be accurate, complete and up to date. Having accurate information enables Vogogo to give you the best possible service. You have the right to access, verify and amend the personal information Vogogo has about you. Vogogo relies on you to keep Vogogo informed of any changes, such as a change of address, telephone number or any other circumstances.

2. Despite Vogogo’s best efforts, errors sometimes do occur. If you identify any personal information that is out-of-date, incorrect or incomplete, please advise our Privacy Officer using the contact information found at Section XIV of this Privacy Policy and corrections will be made promptly and every reasonable effort will be used to communicate these changes to other parties who may have inadvertently received out-of-date, incorrect or incomplete personal information from Vogogo.

3. In order to verify, update or correct any of your personal information collected through the Site, or gain access to the personal information collected through the Site that Vogogo has on file for you, please contact our Privacy Officer using the contact information found at Section XIV of this Policy. If you wish to remove your personal information from the Site please contact our Privacy Officer in writing using the contact information found at Section XIV of this Policy with directions authorizing the removal of your personal information.

1. The Site may contain links to third party websites that are not owned, operated, or maintained by Vogogo and that are not governed by this Policy. Although Vogogo endeavours to link only to websites with high privacy standards, our Policy will no longer apply once you leave the Site. Vogogo is not responsible for privacy policies employed by third parties, and they may be governed by privacy laws applicable in other jurisdictions. When you leave the Site, and access any third party website, read the terms and conditions and privacy statements found on those third party websites to learn how personal information may be collected, used and/or disclosed pursuant to their policies and procedures.

2. Despite any links that might exist on the Site, unless expressly stated otherwise, Vogogo does not control, recommend, or endorse and is not affiliated with these websites or their content, products, services, or privacy policies. Downloading material from certain websites may risk infringing intellectual property rights or introducing viruses into your computer system.

The Site (excluding any links to third party websites) is owned and controlled by Vogogo By accessing the Site, you agree that the statutes and laws of the Province of Ontario and the laws of Canada, without regard to conflict of laws principles, will apply to all matters relating to use of the Site and/or this Policy. In addition, you agree to the exclusive personal jurisdiction and venue for any proceedings relating to the Site and/or this Policy shall be in the appropriate courts or alternative dispute resolution forums of the Province of Alberta, Canada located in the City of Calgary.

2. Visitors to the Site are responsible for their own compliance with local laws regarding website use and access.

If any provision of this Policy shall be held unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining portions of this Policy shall remain in effect.
You may not assign any or all of your rights or obligations under this Policy to any third party. Vogogo may assign any or all of its rights or obligations under this Policy in connection with Vogogo undergoing a corporate reorganization, or negotiating or undergoing a merger or amalgamation with another entity, or negotiating or undergoing a sale of its assets, or if any bankruptcy or reorganization proceeding is brought by or against Vogogo.
